1. Agreement to Terms

Welcome to ArcFit. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ArcFit ("we," "us," or "our") regarding your use of our mobile application (the "App").

By downloading, installing, or using the ArcFit app, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

IMPORTANT: Please read these Terms carefully before using the App. Your use of the App signifies your acceptance of these Terms.

2. License and Access

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your iOS device
• Use the App for personal, non-commercial purposes
• Access and use the App's features and functionality

2.2 License Restrictions

You agree NOT to:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to discover the source code
• Rent, lease, loan, sell, sublicense, or distribute the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality or servers
• Bypass any security features or access restrictions
• Use automated systems (bots, scripts) to access the App

2.3 App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In case of conflict between these Terms and Apple's terms, Apple's terms shall prevail regarding your use of the App Store.

3. User Accounts and Registration

3.1 No Account Required

ArcFit does not require user registration or account creation. All data is stored locally on your device.

3.2 Device Requirements

To use the App, you must:

• Have a compatible iOS device running iOS 17.0 or later
• Have sufficient storage space for the App and your workout data
• Maintain an active internet connection for initial download and updates

3.3 User Responsibilities

You are responsible for:

• Maintaining the security of your device
• All activities that occur on your device
• Backing up your device to prevent data loss
• Keeping the App updated to the latest version

4. App Features and Services

4.1 Free Features

The App provides the following features at no cost to all users:

• Workout logging with 208 exercises across 13 muscle groups
• Create up to 1 custom workout routine
• Progress tracking and analytics (Week view)
• Workout history (Last 7 days)
• Cardio exercise tracking with duration, distance, and intervals
• Superset creation and management
• Rest timer with notifications
• Workout summary sharing with detailed analytics
• Dark mode support

4.2 Premium Features

The following features require a Premium subscription:

• Extended Workout History: View workout history for last 30 days, 6 months, year, or lifetime (free users: 7 days only)
• Advanced Progress Analytics: Track volume, reps, and workouts across month, 3 months, year, or all time (free users: week view only)
• Unlimited Routines: Create and save unlimited workout routines with custom schedules (free users: 1 routine limit)

4.3 Subscription Terms

Premium subscriptions are available through in-app purchase:

• Monthly Subscription: Includes 3-day free trial, then automatically renews at the monthly rate
• Annual Subscription: Billed immediately at the yearly rate, automatically renews annually
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• No refunds for partial subscription periods
• If offered, any unused portion of a free trial will be forfeited when purchasing a subscription

4.3 Feature Modifications

We reserve the right to:

• Add, modify, or remove features at any time
• Update the App with new functionality
• Discontinue features with or without notice
• Introduce premium features or subscriptions in the future (with advance notice)

5. User Content and Data

5.1 Your Data

You retain all ownership rights to your workout data, routines, and any other content you create in the App ("User Content").

5.2 Local Storage

All User Content is stored locally on your device using Apple's SwiftData framework. We do not store your workout data on external servers or in the cloud.

5.3 Data Responsibility

You acknowledge and agree that:

• You are solely responsible for backing up your User Content
• We are not responsible for data loss due to device damage, loss, theft, or iOS updates
• Uninstalling the App will permanently delete all User Content stored locally
• We do not provide data recovery services
• You should regularly back up your device using iCloud or iTunes

5.4 Content Standards

While your User Content remains private on your device, you agree not to create content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights
• Contains malicious code or viruses
• Violates any applicable laws or regulations

6. Intellectual Property Rights

6.1 Our Ownership

The App, including all content, features, functionality, design, graphics, code, and documentation, is owned by ArcFit and is protected by:

• United States and international copyright laws
• Trademark laws
• Other intellectual property rights

6.2 Trademarks

"ArcFit" and related logos, graphics, and service names are trademarks or registered trademarks. You may not use these marks without our prior written permission.

6.3 Third-Party Content

The App uses SF Symbols and other resources provided by Apple Inc. These remain the property of Apple and are used under license.

7. Health and Safety Disclaimer

7.1 Not Medical Advice

IMPORTANT: ArcFit is a fitness tracking tool and does NOT provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice, diagnosis, or treatment.

7.2 Consult Healthcare Professionals

Before beginning any exercise program, you should:

• Consult with a physician or qualified healthcare provider
• Obtain medical clearance for physical activity
• Disclose any health conditions, injuries, or concerns
• Seek professional guidance for exercise selection and intensity

7.3 Assumption of Risk

You acknowledge and agree that:

• Exercise and physical activity involve inherent risks of injury
• You assume all risks associated with using the App and following any workout routines
• You are responsible for exercising safely and within your physical capabilities
• You will stop exercising immediately if you feel pain, dizziness, or discomfort
• We are not liable for any injuries, health issues, or adverse effects resulting from your use of the App

7.4 User-Created Content

Exercise routines and workout plans are user-created or based on publicly available information. We do not verify the safety or effectiveness of any workout routine. Always use proper form and appropriate weights.

8. Prohibited Uses

You agree NOT to use the App for any of the following purposes:

• Any unlawful purpose or in violation of these Terms
• To violate any international, federal, state, or local laws or regulations
• To infringe upon or violate our intellectual property rights or the rights of others
• To harass, abuse, insult, harm, defame, or discriminate
• To submit false or misleading information
• To upload viruses or malicious code
• To collect or track personal information of others
• To spam, phish, or engage in similar activities
• To interfere with security-related features
• To engage in unauthorized framing or linking
• To use any automated system to access the App
• To decipher, decompile, or reverse engineer the App
• For commercial purposes without our written consent

9. Updates and Modifications

9.1 App Updates

We may release updates, patches, or new versions of the App to:

• Fix bugs and improve performance
• Add new features or functionality
• Ensure compatibility with new iOS versions
• Enhance security

You agree to install updates promptly to maintain App functionality and security.

9.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• Material changes will be notified through the App or email
• Your continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the App

9.3 Service Changes

We may, at our sole discretion:

• Modify or discontinue any feature or functionality
• Change the App's appearance, features, or availability
• Impose limits on certain features
• Introduce subscription or premium features (with notice)

10. Termination

10.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Deleting all App data

Uninstalling the App will permanently delete all locally stored workout data.

10.2 Termination by Us

We may suspend or terminate your access to the App:

• If you violate these Terms
• If we discontinue the App
• For any reason at our sole discretion

10.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must cease all use of the App
• You must delete the App from your device
• Provisions that should survive termination will remain in effect

11. Disclaimers and Warranties

11.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation

11.2 No Guarantee

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be available at all times
• Defects will be corrected
• The App is free of viruses or harmful components
• Results or outcomes will be achieved

11.3 Third-Party Services

The App may integrate with third-party services (e.g., Apple services, RevenueCat). We are not responsible for the availability, accuracy, or reliability of these services.

12. Limitation of Liability

12.1 Disclaimer of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCFIT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Personal injury or property damage
• Health-related issues or injuries resulting from App use
• Data loss or corruption
• Unauthorized access to or alteration of your data

12.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE PAST 12 MONTHS (WHICH IS $0 FOR FREE USERS).

12.3 Essential Purpose

The limitations in this section apply even if any remedy fails its essential purpose.

13. Indemnification

You agree to defend, indemnify, and hold harmless ArcFit, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any law or rights of a third party
• Your User Content
• Any injuries or health issues resulting from your workouts

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal claim, you agree to first contact us at nareshalakuntla1234@gmail.com to attempt to resolve the dispute informally.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.

14.3 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in [Your County], [Your State], and you consent to personal jurisdiction in such courts.

14.4 Arbitration

You agree that any dispute arising from these Terms or the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement.

14.5 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. Apple-Specific Terms

15.1 Acknowledgment

These Terms are between you and ArcFit only, not with Apple Inc. Apple is not responsible for the App or its content.

15.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by the App Store Terms of Service.

15.3 Maintenance and Support

ArcFit is solely responsible for providing maintenance and support services. Apple has no obligation to furnish any maintenance or support services.

15.4 Warranty

Apple has no warranty obligation with respect to the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty will be our responsibility.

15.5 Product Claims

We, not Apple, are responsible for addressing any claims relating to the App or your possession/use of the App, including:

• Product liability claims
• Claims that the App fails to conform to legal or regulatory requirements
• Claims arising under consumer protection laws

15.6 Intellectual Property Rights

In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, will be responsible for investigation, defense, settlement, and discharge of such claim.

15.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ArcFit regarding the App and supersede all prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, or accidents.

16.6 Survival

Provisions that by their nature should survive termination shall survive, including Intellectual Property Rights, Disclaimers, Limitation of Liability, and Indemnification.

16.7 Language

These Terms are provided in English. Any translations are provided for convenience only, and the English version shall prevail in case of conflict.
